It is implicit that all clients have read and agreed to the terms and conditions for any work undertaken by MegaPixel Journeys. The following terms and conditions apply to all web site design services offered by MegaPixel Journeys. By ordering services from us you are agreeing to the following terms and conditions.
General
- We reserve the right to refuse to construct a web site which we may judge as unfit due to content or otherwise. This includes, but is not limited by, sites containing adult oriented material such as pornography, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation and sites which infringe copyright laws.
- All material, both text and images, supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
- The copyright for all material provided by MegaPixel Journeys, such as HTML code, graphics, photographs and text, will remain the property of MegaPixel Journeys until such time as payment has been made in full whereupon they will become the property of the client.
- MegaPixel Journeys cannot take responsibility for any copyright infringements caused by materials submitted by the client. MegaPixel Journeys reserves the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
- The rights to photographs, graphics and any third party items such as source code, always remain the property of their respective owners.
- If at any point during the Website design cycle a client wishes to cancel, they may do so but will be invoiced an amount that MegaPixel Journeys judges to be proportional to the amount of work completed.
- MegaPixel Journeys does not undertake to maintain or update a client's website as part of the design commission. If a client wishes MegaPixel Journeys to maintain or update a web site as a separate commission, MegaPixel Journeys will negotiate with the client a maintenance contract appropriate to the amount of work required. Web site maintenance may also be undertaken on a time and materials basis if the client so wishes.
- Once a client has agreed to a content update service, this will only include any content, photographs or text which replaces any current content. It does not extend to producing new sections or pages unless otherwise noted.
- Whilst MegaPixel Journeys recommends hosting companies to host websites, no guarantees can be made as to the availability or interruption of this service by MegaPixel Journeys and we cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.
Website Design
- MegaPixel Journeys makes every effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
- Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, MegaPixel Journeys cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.
- At project acceptance MegaPixel Journeys can provide an estimated completion date, however we cannot guarantee this date as a final completion date.
- The client agrees to make available as soon as is reasonably possible to MegaPixel Journeys all materials required to complete the site to the agreed standard and within the set deadline.
- MegaPixel Journeys will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
- MegaPixel Journeys will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes re content/images that have been provided to us for inclusion on the site.
- A deposit of 50% is required with any standard project before any design work will be carried out. This figure may vairy at MegaPixel Journeys own discretion and is non-refundable.
- Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Once full payment is received for a website, it is assumed that the project has been completed to the clients satisfaction and no refunds will be offered. We do offer free updates for a month after completion to allow for any final amendments that may be required. Any adhoc requirements will be charged accordinly.
- MegaPixel Journeys will endeavor to ensure that any designed site will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer Version 6 and to an acceptable level with Mozilla browsers. MegaPixel Journeys can offer no guarantees of correct function with all browser software.
- Content or features listed in the original quote but not provided during the design phase by the client will be added at any time in the future, however payment must be paid in full including sections which the client still has to provide content for.
- The client is ultimately responsible for checking the correctness of the site before they give MegaPixel Journeys the final approval as sign off and completion of the site.
MegaPixel Journeys reserves the right to change or modify any of the terms and conditions contained in the Terms and Conditions at any time.
